This document, together with the additional information available on www.christianlouboutin.com (the “Site”) constitutes the Terms of Sale (the “ToS”) in force between the user of the Site (“You”, “Your” or the “User”) and Christian Louboutin Australia Pty Ltd, having its head office at Suite 101 Level 1,18 York Street, Sydney, NSW 2000 registered under the number 144 691 127 (“We” or “Christian Louboutin”). It governs the contractual relationship between You and Christian Louboutin in relation to any purchase made on or through the Site (the “Transaction”).
At the time of verification of Your order, by checking the box provided for this purpose and clicking on the "PROCEED TO CHECKOUT" button, You hereby state that You fully and unconditionally accept these ToS.
Christian Louboutin asks You to carefully read the ToS before entering into any Transaction through the Site. You are bound by the version of the ToS that is in force at the time You submit the online form (the “Form”) confirming Your intent to order products on the Site (the “Order”).
Christian Louboutin may at any time amend the ToS, without prior notice. You are advised to regularly check the ToS so as to remain informed of their latest amendments. By continuing to use the Site or the Services, You are agreeing to continue to be bound by these ToS as amended from time to time.
You may place an Order only if your delivery address is located in of the following country: Hong Kong SAR, Macau SAR, Australia, Malaysia, Singapore and Taiwan (the ’’Region’’).

The Site is a secure online platform that allows Users to place an Order online and receive by mail the articles or goods offered for sale on the Site (the “Product(s)”)..
6. Characteristics of Products
The authoritative description of the Products is the description published on the Site at the time of the Order. Christian Louboutin will endeavor to provide the Content and the Products’ descriptions (including images) on the Site as adequately as possible. We will also try to ensure that product descriptions are accurate, complete, current or error-free.
Please refer to our Cancellation Policy stated in Clause 14 below if You feel a Product offered by Christian Louboutin is not as described.
Images of the Products on the Site are provided for information purpose only on Christian Louboutin’s collection and the publication of the Images on the Site shall not constitute an offer, warranty or representation of any kind.
The publication of Products’ descriptions on the Site shall only constitute an invitation to make an offer. By placing an Order, the User is making an offer to Christian Louboutin, and Christian Louboutin has the right but not the obligation to accept or decline the offer in its sole discretion.
You acknowledge and agree that Christian Louboutin cannot guarantee the availability of a Product until same is ready for delivery to You.
Products’ prices are stated in Australian Dollars ($AUSD).
You understand and agree that Products may be subject to taxes (including goods and services tax and and/or costs to transport the Products in the Region (“Taxes and Costs”). These Taxes and Costs are independent from Christian Louboutin’s control. You agree, if applicable, to fully bear these Costs which will appear before You check the box related to the ToS and click on the “PROCEED TO CHECKOUT” button.
Christian Louboutin is not responsible for any bank fees that may be charged due to foreign currency.
All orders are subject to stock availability and confirmation of the order price. Items in your shopping basket are not reserved and may be purchased by other Users.
Each Order is checked paying particular attention to the billing address, the delivery address and the credit card used. You commit to provide only true and accurate information.
Products are available for Your personal use only and not for resale. By placing an Order on the Site, You warrant that You will use the Product for Your personal use only. Moreover, You may not purchase more than four (4) pairs of shoes and/or leather goods in total within thirty (30) days irrespective of whether it is in one (1) or several Orders, and three (3) cosmetic products per Order.
Christian Louboutin, in its sole discretion, reserves the right not to confirm an Order, including but not limited to where there is an assumption that the User will place an Order for resale purposes or commercial exploitation.
When completing the form, You must specify the means of payment that will be used to complete the Transaction in response to Your Order, subject to acceptance by Christian Louboutin.
The following means of payment are accepted by Christian Louboutin: 1. Visa, 2. Master Card, 3. American Express.
We only accept credit cards of individuals (excluding company cards) residing at the billing address. The payment of Your Order is processed through a page hosted by a PCI DSS compliant company. Such company manages the complete payment process. Christian Louboutin does not collect and/or store electronically Your credit card data.
By placing an order using one of the above credit card payment methods, you confirm that the credit card used is Yours or that You have been authorized by the credit card owner to use it.
You further confirm that the address and name indicated in Your Order corresponds to the credit card holder. You acknowledge and agree that the company processing the payment of Your Order may contact the credit card holder directly if necessary for verification and ask him/her for additional information. Such verifications will extend the delivery time by two (2) additional business days. If this condition is not fulfilled and/or the holder of the credit card cannot be reached, Christian Louboutin reserves the right to cancel Your Order. If the credit card holder refuses to authorize payment to Christian Louboutin, We are not liable for any delay in delivery or non-delivery of the Products.
You may prefer Your Order to be placed on the Site by our Customer Service. If so, You shall contact the Customer Service by email at firstname.lastname@example.org or by phone on the number available on our contact us page. Please note that You shall not send any credit card data by email to the Customer Service. The Customer Service will request from You – on the phone exclusively – all information required by the financial institutions (bank or credit card company) to process the payment of Your Order through the hosted order page.
You further acknowledge and agree that Christian Louboutin is not responsible or liable for any losses, damages, costs or liabilities (whether direct or consequential, indirect, economic or otherwise) incurred by you in relation to Your credit card data including but not limited to misuse of Your credit card data by any third parties. To the fullest extent permitted under law, you agree to defend, indemnify and hold Christian Louboutin and its related body corporates (including each of their directors, officers, agents, employees consultants and associates, along with our related companies (including affiliate and subsidiary companies)) harmless from and against all claims, demands actions and expenses brought against Christian Louboutin arising from or in connection with Your credit card data.
Your credit card will only be charged at the time of shipment of Your Order, after checking Your data and upon receipt of the authorization provided by the issuing company and upon acceptance of Your Order by Christian Louboutin.
Subject to the acceptance of Your Order, Christian Louboutin will send You a confirmation of the conclusion of the Transaction to the email address that You provided when placing the Order. The Transaction will only be concluded when Christian Louboutin has confirmed its acceptance by sending You the confirmation email including a summary of the Order, the price of the Products, the date and time of the Order, the shipping fees, taxes and custom duties and the mean of payment chosen by You.
The Customer Service and the shipment service are located South Wales, Australia. Therefore, any Order placed on a public holiday in New South Wales, Australia or on a Saturday / Sunday will be processed on the next business day.
If You wish to cancel or modify your Order before the shipment of Your Products, You must contact the Customer Service as soon as possible. Christian Louboutin will use its reasonable endeavors to fulfill Your request. However, any request for cancellation or modification will be handled by Christian Louboutin in its sole discretion and Christian Louboutin does not warrant that the Order will be canceled or modified upon Your request.
You may register on the Site to obtain a User Account which will allow You to benefit from the Services as described in clause 5 of the ToU. You acknowledge and agree that any personal data which you provide to Christian Louboutin to register a User Account will be collected, used and stored in accordance with Christian Louboutin’s Privacy, referred to at clause 24

Christian Louboutin will send You upon shipment of Your Order, a confirmation email which will contain Your tracking link.
To ensure the safety of Your Order, Christian Louboutin does not directly provide Your tracking number, but Your DHL’s tracking link.
Products will be delivered exclusively to the address mentioned on the online Form submitted by You at the time of the Order. You are responsible for ensuring the accuracy of the delivery address. You will be charged the shipping fees, which vary according to the type of shipment and the place of delivery of the Products. Shipping fees are indicated at the time of placement of the Order.
Shipping costs are charged depending on the country where the delivery has to be made. We are offering complimentary shipping and return for Australia , Hong Kong S.A.R., Macau S.A.R., Singapore, Malaysia and Taiwan Region.
You agree and recognize that shipment’s options vary, depending on the country where Your Order has to be delivered. Deliveries in the Region are made by DHL. We do not deliver to PO Boxes or freight forwarding companies. Your physical presence is always required for delivery
Nevertheless, and in all cases, You will have access to the date of delivery of Your products scheduled by the carrier while filling out Your order, via DHL’s interface.
Christian Louboutin endeavors to ship Your Order as soon as possible after completion of the Transaction. You acknowledge and agree that Christian Louboutin shall not be liable for late delivery, damage due to transportation or any other damage directly or indirectly related to the shipment of Products.
At the time of delivery of Products, You are responsible for immediately verifying that the packaging is intact and has not been altered in any way whatsoever. By Your acceptance of Products at the time of delivery, You acknowledge and agree that Christian Louboutin shall not be responsible for the Products and You shall accept full responsibility and liability of the Products from that moment on. In the event that the packaging is damaged, You shall be responsible for (i) taking detailed pictures of the box and of the Products, (ii) immediately reporting the alleged damage to the carrier in charge of delivery (the “Carrier”) by expressly reserving Your rights upon delivery of the Products and (iii) informing the Customer Service within three (3) working days at: email@example.com or on one of the phone numbers available on our contact us page.
In case of express reservations of Your rights under the conditions mentioned in the previous paragraph, with the carrier and / or customer service of Christian Louboutin, an investigation will be opened with the carrier and a reply will be sent to You within seven (7) working days.
In the absence of such express reservation of Your rights, delivery shall be considered as accepted by You and no dispute on the packaging shall be validly brought by You afterwards.
All Orders placed on the Site are sent with their original box and accessories (such as a dust bag, repair tap-heels for shoes if any, depending on the type of Product), and carefully packed.
Christian Louboutin offers You a free gift wrap with each Order. You will be asked to select this option at the beginning of your Order.
If the Products are delivered as a gift to a third person, You may add a personal message to the Order, which will be hand-written or printed on a dedicated Note card. This option may be selected at the beginning of Your Order. You are solely responsible for the content of this message.
Online Orders cannot be returned in any of Christian Louboutin’s boutiques. Returned merchandise must also include the original shoe box, dust bag, heel taps, and adhesive sole tags and must be returned to us within 30 calendar days from the date of delivery. If You return the Product(s) using your own preferred collection or postal services, You will be required to pay the costs of returning the Product(s) and Christian Louboutin will not be responsible for the shipping charges and any customs, duties, taxes or brokerage fees incurred on Your shipment.
You may not return the Product(s) without Christian Louboutin's express prior authorization. If your cancellation is accepted, the Customer Service will provide you with the instructions to return Your Product(s) by DHL, as set out in the Return Instructions document placed with Your Order.
The Product(s) returned will be inspected upon receipt by Christian Louboutin to verify they comply with the following return conditions.
Products returned must include the original parcel, the original box and all related accessories included when You opened the parcel, such as: dust bag(s), replacement tap-heels, warning-sticker protecting the front part of the red sole, instruction booklets etc. If not, You may incur the payment of a fee.
Returns will only be accepted for Products unused and in their original condition. In particular, the red outsole of the shoes are fragile and must be unmarked and in perfect condition. You must try the shoes only on a clean and carpeted surface and with the warning sticker in place on the front part of the red outsole until You are certain to keep them.
In addition, You agree to take particular care when packing the Products to be returned. Returns will only be accepted if the packaging of the said Products is undamaged and intact.
Christian Louboutin reserves the right to refuse any return on merchandise that appears to have been worn, damaged, soiled, altered or anything Christian Louboutin reasonably believes that has been used, or if the returned Products have been damaged due to improper packing. Christian Louboutin may also accept the return but only with a partial refund (price reduced with repair or replacement costs).
If Your return package is not accepted, it will be sent back to You at Your expense and no refund will be granted. If You follow the return process described precisely in the Return Instructions and if You respect the conditions set out above, You will not bear the return shipping costs.
Following receipt of Your Products in return, and provided that the return conditions are met, Christian Louboutin shall notify You by email that the corresponding refund is being processed. A credit shall then be issued in the same form as the original payment. Christian Louboutin will not refund the transport costs that have been incurred during initial delivery to You.
For online purchases Christian Louboutin will accept merchandise in its original condition for exchange within 30 calendar days of the date of purchase if accompanied by the original receipt. Exchanged merchandise must include the original shoebox, dust bag, and heel taps, and must be returned to us within 30 calendar days from the date of delivery (i.e. your return shipment must be postmarked within 30 days from receipt of your order).
Please follow all of the procedures and requirements above to return your merchandise to our facility. We can facilitate a one-time direct exchange on an order upon request. Exchange can only be facilitated for a different size of the same style, or for another item of the exact same value. An exchange is subject to availability of the requested item at the time of processing and we will do our best to ensure your request is satisfied. Should the requested item not be available to fulfill your exchange, a refund will be issued to the original form of payment. Please contact an online representative to confirm your exchange request by email at firstname.lastname@example.org or by phone on the number available on our contact us page.
Alternatively, you may submit a new order as your exchange, and your original purchase will be refunded to the original form of payment. If the right size, style, or color is not available online, please contact us for further assistance.
16. Australian Consumer Law Guarantee
Our Products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the Products repaired or replaced if the Products fail to be of acceptable quality and the failure does not amount to a major failure.
If you wish to exercise your rights under Australian Consumer Law and return the Product, please stop using the Product and contact Customer Service, by email at email@example.com or by phone on the number available on our contact us page. Customer Service may direct you to:
• provide further information via email including details of the alleged major failure, purchase date, number of the Order and invoice, date of delivery and delivery receipt to enable Christian Louboutin to assess the Product; and/or
• return the Product through DHL Express within 10 business days of notifying Customer Service of the alleged major failure.
You are generally responsible for returning the Product and will be entitled to recover, in addition to a refund or exchange, the reasonable postage or transportation costs from Us if we determine the Product has a major failure.
To the extent permitted by law, Christian Louboutin reserves the right to reject your claim if it determines (acting reasonably) that the Product does not have any major fault for which it is responsible, or the Product has been subject to fair wear and tear. In those instances, the Product(s) will be returned to You at Your expense.
Christian Louboutin undertakes to ensure that high quality standards are continuously met in the manufacturing of all Products. Every Product is controlled before being shipped. Notwithstanding this, if Your Product shows any defect on delivery (Defect on Delivery), You must contact Customer Service within five (5) working days after receiving the Product via email at firstname.lastname@example.org, by phone on the number available on our contact us page. You will be required to provide us details of the alleged Defect on Delivery including the following supporting documents: detailed photos of the Products and alleged defects, purchase date, number of the Order and invoice, date of delivery and delivery receipt.
After considering your documentation, Christian Louboutin reserves its right to recover the Products to undertake a physical investigation, in which case you must arrange for the Products to be returned to us within ten (10) business days.
If the Product contains a major failure, clause 16 shall apply. In all other instances, to the extent permitted by law, Christian Louboutin reserves the right to reject your claim if it determines that the Product has a defect for which You are responsible or the Products have not been returned within the timeframe required by this clause. In those circumstances, the Product(s) will be returned to You at Your expenses.
Christian Louboutin’s liability in relation to the Transaction is limited to that set out in clause 15 and 16 above.
The red lacquer of the outsoles wears out with the use of the shoes. This is not a manufacturing defect of the shoe, but a consequence of wear and tear arising from normal usage.
Christian Louboutin strongly recommends that You consult a professional in leather care or a shoemaker for specific care advice.
In order to keep Your shoes in good condition, it is recommended that You follow a general leather care as follows: keep the leather area clean and dry using a dry soft cloth; always store Your products away from light and heat; protect Your leather goods from rain and moisture; store Your products in the Christian Louboutin dust bag provided to You when You are not wearing them; avoid contact with abrasive surfaces.

Christian Louboutin endeavours to maintain at all times the highest standards of security for its online platform. Christian Louboutin uses SSL (Secure Socket Layer) encryption and has also reinforced all of the various encryption processes in order to provide the most effective protection possible for all sensitive payment information.
You acknowledge and agree that Christian Louboutin does not have any access to confidential information about the means of payment used by its customers and Christian Louboutin is not responsible or liable for any losses, damages, costs or liabilities (whether direct or consequential, indirect, economic or otherwise) incurred by you in relation to the payment used by You.
